Guidance Notes on Progress Reports

The CER has today (11th January) published the Guidance Notes on Progress Reports requirements for holders of an Authorisation to Construct granted by the CER pursuant to section 16 of the Electricity Regulation Act 1999 (" the 1999 Act").

 

Authorisation to Construct

Under section 16 of the Electricity Regulation Act anyone wishing to construct a new generating station or reconstruct an existing generating station must obtain an authorisation from the CER prior to commencing work.

Please note that in the Commission's decision paper, CER/08/161, it was determined in accordance with Section 16(3A) of the Electricity Regulation Act 1999 (as inserted by Regulation 13(b) of the European Communities (Internal Market in Electricity) Regulations 2005 (S.I. No. 60 of 2005)) that generators with an installed capacity not exceeding 1MW are subject to specific terms and conditions as set out in the relevant Order but are not required to apply to the Commission in order to stand duly authorised. This decision and the associated Order are available HERE

In addition licence applications for plants less than or equal to 40 MW shall be assessed as specified under CER Decision (CER/10/098).

    Authorisation to Construct

    Licence to Generate

    Under section 14 of the Electricity Regulation Act all generators must obtain a generation licence from the CER. The CER can consider a number of factors in evaluating a licence application. These may include, for example, the availability of sufficient appropriate financial, managerial or technical resources to ensure that the generator is able to comply with the terms and conditions that govern the electricity generation licence.     Please note that in the Commission's decision paper, CER08161, it was determined in accordance with Section 14(1A) of the Electricity Regulation Act 1999 (as inserted by Regulation 16(b) of the European Communities (Internal Market in Electricity) Regualtions 2005 (S.I. No. 60 of 2005)) that generators with an installed capacity not exceeding 1MW are subject to specific terms and conditions as set out in the relevant Order but are not required to apply to the Commission in order to stand duly licensed.
