The Commission has today (17 February 2009) published a decision paper following the request received from Imera Ltd for an exemption from EU Third Party Access Rules for two planned East West Electricity Interconnectors between Ireland and Great Britain. This decision follows from the consultation on 20 June 2008. This decision also reflects the amendments recommended by the European Commission following the Commission’s Decision. A similar exemption was issued by the UK energy regulator Ofgem.

Consultation
The Commission has today (20 June 2008) published a consultation paper on a request received from Imera Ltd for an exemption from EU Third Party Access Rules for two planned East West Electricity Interconnectors. This consultation follows from a revised exemption application made by Imera in May 2008.
The EU regime recognises the special risks and challenges facing new merchant interconnectors. Certain circumstances may warrant an exemption from the full application of third party access rules. Authorities in both jurisdictions, CER and Ofgem in this case, must be satisfied that six specific criteria are met, the European Commission has been notified and has not objected to the proposal. The consultation paper outlines the EU exemption regime, the Imera Project, the market context of the East West interconnection, and evaluates whether the project meets the criteria necessary for exemption. The Commission's initial view is that the criteria are met. A similar request for exemption is being considered by the UK energy regulator Ofgem.
