The Energy (Miscellaneous Provisions) Act 2006 introduced a regime for the authorisation and licensing of electricity interconnectors by the CER by way of amendments to the Electricity Regulation Act,1999. Prior to this there was no specific statutory obligations relating to their construction or licensing.
Pursuant to the statutory provisions the CER drafted a new licence for the purpose of licensing interconnectors. This draft licence was the subject of a previous consultation.
Following this consultation the CER issued a proposed decision in December 2010 (CER/10/230) requesting that interested parties make any comments of a substantive nature. Three parties responded to the consultation and their respective submissions are published along side this document.
Following consideration of the issues raised by respondents the CER is now publishing the final form of the interconnector.

Following comments received in the consultation process the CER is issuing the finalised licence as a proposed decision should any parties have substantive comments to make. The responses received and the CER position is also being published.

The CER is today (29 October 2009) publishing a paper on the subject of Interconnector Licensing.
The draft licence being consulted upon contains twenty conditions; standard conditions which are consistent with the standard conditions as set out in other licenses issued by the CER. Other conditions deal with the capacity utilisation, use of revenues, and access to the interconnector.
Overall the CER is asking interested parties to comment on the appropriateness of the conditions in the licence. The CER is also asking interested parties to suggest if further conditions are required. Finally the CER is seeking views as to whether the licence adequately covrs the future provisions of the 3rd package.
